You are entitled to 52 weeks maternity leave in total - 26 weeks Ordinary Maternity Leave (OML) plus 26 weeks Additional Maternity Leave (AML).
If you return to work after OML you have the right to return to your job on exactly the same terms. This applies also if you return after AML unless your employer shows that it’s not reasonably practicable for them to take you back in your original job (for example because the job no longer exists). In that case you must be offered suitable alternative work on similar terms and conditions. If you are denied any of these rights you may be able to go to an employment tribunal. If you want to return to work before the end of your maternity leave you must give your employer eight weeks notice of the date you wish to return.
If you are a new dad and your partner is returning or has returned to work, you could have the right to up to 26 weeks' Additional Paternity Leave
